Pagaidu administrācija lems par pieteikuma ST atsaukšanu
31.07.2024 Rēzeknes pašvaldības pagaidu administrācija šonedēļ plāno lemt par atlaistās domes iesniegtā pieteikuma Satversmes tiesā (ST) atsaukšanu, liecina pagaidu administrācijas izsludinātās sēdes darba kārtība.Trešdien, 31.jūlijā, pagaidu administrācija plāno skatīt jautājumu par Rēzeknes domes ST iesniegtā pieteikuma "Par Rēzeknes valstspilsētas pašvaldības domes atlaišanas likuma un 2024.gada 20.jūnija likuma "Grozījumi Pašvaldības domes vēlēšanu likumā" neatbilstību Latvijas Republikas Satversmes 1. un 101. pantam" atsaukšanu.
Kopumā sēdē iekļauti 16 darba kārtības jautājumi, tostarp lēmumprojekts par pašvaldības Bērnu tiesību aizsardzības programmas 2024.-2027.gadam apstiprināšanu. Sēde paredzēta plkst.14.
Iepriekš ST aģentūrai LETA precīzu vērtējumu, vai pagaidu administrācija var atsaukt iesniegumu ST, nesniedza. ST vien norāda, ka, saņemot lūgumu par tiesvedības izbeigšanu, tiesa izvērtē, vai lūgumu iesniegusi persona, kura ir tiesīga to darīt. Konkrētajā gadījumā to, vai pagaidu administrācija ir tiesīga atsaukt pieteikumu, ST varēšot izlemt, tikai izskatot konkrētu lūgumu.
Gadījumā, ja pieteikumu atsauc persona, kurai ir uz to tiesības, ST nav pienākuma izbeigt tiesvedību. Tiesa var turpināt tiesvedību, ja tas nepieciešams, lai novērstu būtisku sabiedrības interešu apdraudējumu, dotu vērtējumu konstitucionāli nozīmīgos jautājumos vai citu apsvērumu dēļ, atzīmē ST.
Kā vēstīts, ST ierosināta lieta par Rēzeknes pašvaldības domes atlaišanas likuma un Pašvaldības domes vēlēšanu likuma normu atbilstību Satversmei.
ST uzaicināja institūciju, kas izdevusi apstrīdēto aktu, - Saeimu - līdz septembra beigām iesniegt tiesai atbildes rakstu ar lietas faktisko apstākļu izklāstu un juridisko pamatojumu.
